Marietta DUI Court

To be convicted of DUI, the state must prove you are guilty beyond a reasonable doubt. In other words, although you were arrested for driving under the influence, the prosecution must provide evidence that shows you are indeed guilty of the offense. If guilt cannot be proven, your case will be dismissed and the charges against you dropped.
So what type of evidence will be used to prove you guilty in court? In most cases, the prosecution will rely on the arresting officer’s testimony, as well as your field sobriety and/or chemical test results. What’s more, if the police vehicle was equipped with a video camera, the footage of your arrest may also be submitted as evidence during your trial.
There are a number of tactics that can be used to challenge the evidence against you. For example, if the arresting officer failed to provide clear instructions for any field sobriety tests he or she administered, your test results may be inadmissible in court. Likewise, if you were given a breathalyzer from an officer who was not properly trained—or the testing device was not appropriately maintained—the court may not permit the results to be used against you.
