Although it may seem as if the odds are against you—after all, you were probably arrested after failing a breathalyzer and/or field sobriety test—you actually have the upper hand. As our Constitution specifies, you are innocent until proven guilty in a court of law. This means you cannot be convicted of DUI if the state does not successfully prove you committed the offense.

Even if both of these requirements are met, you may still be able to challenge your breath and/or field sobriety test results. The device used to administer breath tests in Georgia is known for its faults and, if the officer is unable to prove it was maintained properly, your results may be inadmissible. Likewise, if he or she was not trained to administer field sobriety breath tests, your results may be invalid.
