It is important to know that being arrested for DUI does not mean you will be convicted of the offense. Like any other person facing criminal charges, the prosecution must provide evidence that shows you are in fact guilty of committing the crime in question. And to do this, a number of factors must be proven in court.
First and foremost, the officer who arrested you must prove he or she had reason to suspect you were under the influence of drugs or alcohol. For example, if your speech was slurred or you showed other physical signs of intoxication, your arrest was probably warranted. If there was no evidence to indicate you were under the influence, your arrest may have therefore been unconstitutional.
The officer must also show that he or she had a valid reason for pulling you over initially—such as speeding or violating other traffic laws. If there was no reason for the traffic stop, the judge is likely to dismiss your case. Keep in mind that things like driving late at night or in certain neighborhoods are not valid reasons for an officer to stop a driver.
Assuming your arrest was warranted, the prosecution must next prove you were legally intoxicated at the time of your arrest. Typically, this is done by submitting evidence such as breathalyzer and/or field sobriety test results. However, if these tests were improperly administered, or the breath testing device was not functioning properly, your results may be inadmissible in court.
