Most Marietta roadblocks take place on weekends between the hours of 11 p.m. and 4 a.m., and are set up near popular bars, clubs, and restaurants. Depending on your performance of these sobriety tests, the officer may ask you to perform a breathalyzer in order to determine your blood alcohol content (BAC). Should your results indicate a BAC above the legal limit of 0.08%, you will likely be arrested and charged with driving under the influence.
To prevent an arrest during a DUI roadblock, you should avoid answering any questions about your prior alcohol use. Under Georgia law, officers can only ask for basic information about your identity—usually your name and address. It is in your best interest to politely decline to answer any additional questions you are asked.
It is important to know that, unlike breath tests—which you are legally required to take if asked—field sobriety tests are entirely voluntary. In fact, because these tests are entirely subjective, you should again decline the officer’s request. Finally, never allow a police officer to search your vehicle if he or she asks.
