Marietta DUI Third Offense

Marietta DUI Third Offense
If you have ever been convicted of driving under the influence (DUI) in Marietta, then you know that the penalties for drunk driving are anything but lenient. However, what you may not realize is that, if you are charged with a third DUI offense, you will face even harsher sentencing guidelines than you did in the past. At the very least, you can expect to spend time in jail, lose your driving privileges, and pay thousands of dollars in fines if you are convicted of a Marietta DUI third offense.

The extent of your punishment will depend largely on the amount of time that has passed since your last DUI conviction. If this is your third conviction within a 10-year period, your sentence may include up to a one-year jail sentence. If the judge is feeling generous, he or she may suspend this sentence in lieu of probation, but under Georgia law, you will be required to spend at least 15 days behind bars. You may face an even longer sentence if only five years have passed since your last DUI conviction.

In addition to serving a mandatory jail sentence, you could also be fined anywhere from $1,000 to $5,000 for your offense. The judge may also order you to undergo treatment for alcohol abuse, perform community service, and/or install an ignition interlock device in your vehicle (which means you will have to pass a breath test any time you attempt to start up your vehicle). But don’t think that installing an ignition interlock device means you won’t lose your driver’s license. As a repeat DUI offender, you can expect your driving privileges to be revoked for two to five years.

Following a third DUI conviction, you will be required to trade in your current license plate for one that’s reserved for DUI offenders—which can be rather embarrassing at times, especially if another driver is the primary user of your vehicle. To top it all off, you must also pay to have your name and picture published in a local newspaper’s listing of convicted drunk drivers.
