Marietta Yellow DS-1205 Form (10 Business Day Letter of Appeal)

Marietta Yellow DS-1205 Form (10 Business Day Letter of Appeal)
While it is one of the most familiar expressions in our society, the age old saying “driving is a privilege, not a right” can quickly turn ominous if you are charged with driving under the influence (DUI) in Marietta. Even if you are not convicted of the offense, a drunk driving charge can put your driving privileges at risk and lead to an automatic license suspension. Fortunately, you may be able to appeal your suspension by requesting a hearing with the DMV. However, in order for that to happen, you must complete a Marietta DUI Yellow DS-1205 Form—and you have just 10 days to submit it.

You were probably given several documents after your arrest. Along with a citation and a notification of your scheduled court date, these documents should include a DUI Yellow DS-1204 Form (also known as a 10 business day letter of appeal).  As detailed on this form, your driving privileges will be suspended in 10 business days if you do not request an administrative hearing with the DMV.

To restore your license, you must complete the DS-1204 form and submit it to the appropriate Department of Driver Services before the 10-day deadline. Until this hearing takes place, the DS-1204 will also serve as a temporary driver’s license, as your original copy was most likely confiscated when you were arrested.

If you do not request a hearing, or submit the form late, you can expect to lose your driving privileges for up to a year. If you have been convicted of DUI in the past, or were involved in a serious auto accident at the time of your arrest, the suspension could be even longer.

Fortunately, with the right legal strategy, you can substantially improve your chances of obtaining a successful outcome at your DMV hearing. In addition to helping you submit the DS-1205 form, a skilled DUI defense attorney can oftentimes challenge your DUI arrest and convince the court to restore your driving privileges.
